Throughout this website, the terms “we”, “us” and “our” refer to PUKE Apparel and OUT THERE OZ PTY LTD as the operator of PUKE Apparel, where the context requires. By accessing our website, browsing our website, placing an order, requesting a merch package, approving artwork, supplying material, participating in a sponsored vehicle arrangement, or using any PUKE Apparel service, you agree to be bound by these Terms of Service, together with any policies referenced in them, including our Returns & Refunds Policy, Shipping Policy, Privacy Policy, and any other policies published on our website from time to time.
These Terms apply to all users of the website, including browsers, customers, custom merch customers, Pride & Joy customers, private crew customers, sponsored vehicle applicants, sponsored vehicle participants and other users of the site.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under applicable law, including under the Australian Consumer Law.
2. Eligibility and Acceptable Use
By using this website, you confirm that you are at least the age of majority in your state, territory, or country of residence and are legally capable of entering into binding contracts.
You agree not to use our website, products, or services:

We reserve the right to withdraw, discontinue, modify, remove, pause, unpublish, or limit products at any time without notice, including where required for operational, legal, security, supply, brand, reputation, approval, platform, customer service or creative reasons.

5. Pricing and Currency
All prices displayed on this website are in Australian Dollars (AUD) unless otherwise stated.
We aim to display prices clearly and accurately. Where required by law, displayed prices will include all unavoidable or pre-selected charges known at the time of purchase.
Additional charges such as customs duties, import taxes, VAT, brokerage fees, foreign exchange fees, or charges imposed by banks, payment providers, or government authorities may apply to some transactions, particularly international orders. Unless expressly stated otherwise at checkout, these charges are the customer’s responsibility.
Sponsored vehicle merch, Pride & Joy merch, private crew merch, artwork setup, design setup, social add-ons, paid media add-ons, sponsored vehicle packages, custom designer options, supporter drops and other custom services may be priced separately from standard store products.
We reserve the right to correct pricing, description, availability, or typographical errors and to cancel or decline orders affected by such errors, including after an order has been submitted.
6. Orders and Order Acceptance
When you place an order through our website, you are making an offer to purchase the selected products.
All orders are subject to acceptance by us. We may accept, reject, limit, or cancel an order for reasons including:

- suspected fraud or unauthorised activity
- pricing or listing errors
- incorrect customer information
- payment issues

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order, except where a non-refundable custom service, setup, design, media, production or other agreed paid service has already been provided and applicable law allows the amount to be retained.
7. Shipping and Delivery
Shipping availability, shipping methods, and estimated delivery timeframes are set out in our Shipping Policy, which forms part of these Terms.
Shipping charges are calculated and disclosed through the website or at checkout where applicable.
Any delivery dates or timeframes shown on the website or at checkout are estimates only and are not guaranteed.
We use third-party carriers for delivery. However, if a product arrives damaged, incorrect, or not in acceptable condition, the customer’s rights are generally against the seller they purchased from, and we remain the first point of contact for resolving the issue.
For international orders, customs processing, border inspections, duties, taxes, and local import requirements may cause delays or additional charges outside our control.
8. Risk, Title, and Delivery Issues
Risk in goods does not shift our obligations under any law that applies to your purchase. Nothing in these Terms is intended to exclude any rights you may have where goods are lost, damaged, defective, materially misdescribed, or not supplied within a reasonable time.

9. Returns and Refunds

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Custom, personalised, made-to-order, design setup, artwork setup, social add-on, media add-on, sponsored vehicle services, Pride & Joy services, private crew services, supporter drops and other custom services may have different cancellation and change-of-mind rules, as set out in these Terms and any relevant product or service page. Nothing in those rules excludes rights that cannot lawfully be excluded.
10. International Customers
If you purchase from outside Australia, you may also have rights under the consumer laws that apply in your country or place of delivery. Nothing in these Terms excludes any rights or remedies that cannot lawfully be excluded under applicable law.
11. Accuracy of Website Information
We make reasonable efforts to ensure that information on this website is accurate and current, including product descriptions, prices, availability, and visual representations.
However, errors, delays, or omissions may occur. We reserve the right to correct such issues and to update information, remove listings, pause listings, or cancel affected orders where reasonably necessary.
Recognisable symbols, images, logos, event references, sponsor references, vehicle references, and overall visual presentation can shape what consumers believe about a product. Businesses and customers supplying material should ensure those representations do not create a misleading impression.
12. Intellectual Property
All content on this website, including text, graphics, logos, images, branding, product names, designs, layout, creative assets, product listings, campaign assets, website pages, videos and other materials, is owned by or licensed to PUKE Apparel and is protected by applicable intellectual property laws.
You must not reproduce, distribute, adapt, publish, exploit, copy, scrape, resell, commercialise, or use any website content without our prior written permission, except as permitted by law.
Editable artwork files, templates, source files, print files, design files, working files, mockups, campaign assets, production files, product listing files and commercial resale rights are not included with any product, service, setup fee, merch package or media add-on unless agreed separately in writing.
PUKE Apparel may retain working files, design files, artwork versions, mockups, templates, creative assets, product listing assets, campaign materials, social media assets, media files and production references created during the design, listing, marketing and production process.
13. Sponsored Vehicle Merch, Pride & Joy Merch, Private Crew Merch, and Customer-Supplied Material
PUKE Apparel may offer sponsored vehicle merch, Pride & Joy vehicle merch, private crew merch, custom vehicle merch, supporter drops, public merch listings, private or unlisted merch links, social promotion, category features, AI-assisted artwork, designer-assisted artwork, paid add-ons, campaign support and related services through PUKE Burnout Garage or other PUKE Apparel programs.
By requesting, purchasing, approving, promoting, supplying material for, participating in, or applying for a sponsored vehicle package, Pride & Joy package, private crew package, supporter drop, public listing, private listing, campaign, social promotion or related merch service, you agree that these additional terms apply.
Customer-Supplied Material
Where you supply vehicle photos, logos, sponsor logos, business logos, event names, event logos, crew names, team names, slogans, artwork, references, images, designs, videos, social content, audio, written content or other material, you warrant that you own that material or have obtained all approvals, licences, permissions and authority required for PUKE Apparel and OUT THERE OZ PTY LTD to use that material for design, production, product listing, sale, fulfilment, marketing, social promotion, media production and related campaign activity.
You are responsible for any claim, complaint, takedown request, dispute, loss, cost, damage, expense, legal issue, platform issue, sponsor issue, event issue or third-party objection that arises from material you supplied, requested, approved, promoted or represented as authorised.
To the extent permitted by law, you agree to indemnify PUKE Apparel and OUT THERE OZ PTY LTD against claims, complaints, takedown requests, losses, costs, damages, expenses, or legal issues arising from material you supplied, requested, approved, promoted, or represented as authorised.
PUKE Apparel may request proof of permission at any time. We may refuse, pause, edit, remove, withdraw, cancel, unpublish, decline or limit any design, product, listing, campaign, social post, artwork, order, media asset or service where permission is unclear, disputed, legally risky, unsuitable, misleading, offensive, poor quality or inconsistent with our brand standards.
Ownership of PUKE-Created Work
Unless agreed separately in writing, PUKE Apparel and OUT THERE OZ PTY LTD own all design concepts, artwork layouts, mockups, product listings, campaign assets, promotional wording, videos, images, templates, print files, working files, creative direction, production assets, social media assets, website assets and related materials created by us as part of any sponsored vehicle merch, Pride & Joy merch, private crew merch, custom vehicle merch, social promotion, category feature, media add-on or related service.
The customer retains ownership of material they supply, such as vehicle photos, sponsor logos, business logos, event references, crew names, team names, slogans, third-party artwork, social content or other supplied material, but grants PUKE Apparel and OUT THERE OZ PTY LTD permission to use that supplied material for the approved design, listing, sale, fulfilment, marketing, media production, social promotion and campaign activity connected to the related merch or service.
Purchasing a product, setup service, design service, sponsored package, Pride & Joy package, private package, supporter drop, media add-on or social promotion does not transfer ownership of PUKE-created artwork, layouts, mockups, source files, print files, editable files, product listings, templates, campaign assets, media assets or commercial reproduction rights unless expressly agreed separately in writing.
No Official Affiliation Unless Agreed in Writing
Unless clearly stated in writing by PUKE Apparel, sponsored vehicle merch, Pride & Joy merch, private crew merch, custom vehicle merch, event-inspired merch, social posts, category features, vehicle listings, supporter drops or promotional content are not official merchandise of any event, venue, promoter, manufacturer, racing body, sponsor, business, brand, team, club, series or third party.
Use of a vehicle, business name, sponsor reference, event reference, logo, venue reference, series reference or third-party material does not imply endorsement, approval, sponsorship, partnership, agency, official merchandise status or official affiliation unless that approval has been confirmed in writing by the relevant authorised party.
Sponsored Vehicle Approval
Sponsored vehicle packages are subject to approval by PUKE Apparel. Approval is not automatic and may be refused, limited, suspended or withdrawn at our discretion.
We may suspend or remove a sponsored vehicle listing, profit split pathway, social feature, product page, promotional post, category feature or related campaign if we consider that the arrangement creates legal risk, reputational risk, brand risk, approval issues, customer confusion, poor conduct, misleading impressions, operational issues, payment issues, refund issues, chargeback issues, platform issues, commercial issues or any other concern that may affect PUKE Apparel or OUT THERE OZ PTY LTD.
Sponsored vehicle approval does not create employment, agency, partnership, franchise, joint venture, ambassador status, automatic sponsorship rights, exclusivity, official endorsement or an ongoing commercial relationship unless separately agreed in writing.
Ending, Pausing, or Removing Listings and Support
PUKE Apparel may pause, unpublish, remove, end, limit or change any public listing, private link, sponsored vehicle support, Pride & Joy listing, private crew listing, social support, category feature placement, promotional post, profit split pathway, supporter drop or related campaign where we consider it reasonably necessary for legal, operational, brand, reputation, customer service, payment, stock, approval, platform, conduct or commercial reasons.
We may remove or pause a listing or campaign immediately where there is a legal issue, permission issue, disputed logo or artwork, misleading impression, poor conduct, payment issue, refund issue, chargeback issue, reputational concern, event objection, sponsor objection, platform issue or any other risk to PUKE Apparel or OUT THERE OZ PTY LTD.
Where there is no urgent legal, safety, payment, approval, platform or reputation issue, we may provide reasonable notice before ending a sponsored listing, public listing, private link, social support, category feature placement or related support.
Ending or pausing a listing does not affect orders already placed unless those orders are cancelled, refunded or unable to be fulfilled. Any eligible payout or profit split on qualifying sales made before the listing is ended will be handled according to the written agreement for that specific arrangement.
Customer Withdrawal or Listing Removal Requests
A customer may request that PUKE Apparel remove, pause, unpublish, make private or otherwise limit a public merch listing connected to their vehicle, crew, build or supplied material.
We will review removal requests and, where reasonably practical, remove, pause or adjust the relevant listing, link or promotion within a reasonable time. However, we cannot guarantee removal of content already shared, cached, screenshotted, indexed, forwarded, downloaded, reposted or posted by third parties.
Customer withdrawal does not automatically create a refund for completed design work, artwork setup, product setup, listing setup, custom media work, social add-ons, paid promotion, made-to-order products, orders already produced, or orders already in progress. This does not exclude any rights the customer may have under the Australian Consumer Law where goods or services are faulty, incorrect, materially misdescribed or fail to meet consumer guarantees.
If a customer withdraws from a sponsored vehicle arrangement, public listing, private listing, Pride & Joy listing, private crew listing or supporter drop, PUKE Apparel may stop taking new orders, end related social support, remove featured placement, close private links and close any future profit split or payout pathway from the date the listing is removed or the arrangement is ended, subject to any written agreement already in place.
Profit Split Payout Pathway
Any profit split, payout, commission, sponsored vehicle return, supporter payment or similar arrangement only applies where PUKE Apparel has approved it in writing for that specific vehicle, design, listing, campaign or arrangement.
Unless separately agreed in writing, any profit split or payout is calculated only on qualifying sales actually received and retained by PUKE Apparel, after applicable production costs, supplier costs, discounts, refunds, returns, chargebacks, payment fees, taxes, shipping adjustments, cancelled orders and other relevant costs or deductions.
PUKE Apparel may set payout timing, payout method, minimum payout thresholds, eligibility rules, reporting requirements and payment conditions. No payout is owed on refunded, cancelled, fraudulent, unpaid, disputed, reversed or chargeback-affected orders.
No profit split, payout, commission, supporter payment or sponsored return is automatic unless confirmed in a separate written agreement for the relevant vehicle, listing or campaign.
Design Approval
Before production begins, the customer must review and approve the final design direction, including spelling, names, vehicle details, sponsor placement, logo use, artwork placement, colours, garment choice, front or back print placement, wording, public listing details, private listing details and any other relevant design or campaign details.
Once a design is approved, the customer accepts responsibility for approved details unless the final supplied product is faulty, incorrect, materially misdescribed, or otherwise covered by rights that cannot be excluded under applicable law.
AI-assisted or designer-assisted vehicle artwork may be stylised and may not be an exact technical reproduction of the vehicle. It is the customer’s responsibility to review and approve the final artwork before production.
Custom, Personalised, and Made-To-Order Items
Sponsored vehicle merch, Pride & Joy merch, private crew merch, custom vehicle merch, personalised items, made-to-order items, design setup, artwork setup, product setup, listing setup, social add-ons, media add-ons and custom media work may not be eligible for cancellation, change-of-mind returns or refunds once design work, setup, production, fulfilment or promotional work has started.
Nothing in this section excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law where goods are faulty, incorrect, materially misdescribed or fail to meet applicable consumer guarantees.
Social Promotion and Category Features
Where PUKE Apparel or OUT THERE OZ PTY LTD provides social posts, re-shares, videos, category features, promotional wording, campaign support, or other media services, final approval of wording, timing, platform, format, placement, duration, suitability and rotation remains with PUKE Apparel and OUT THERE OZ PTY LTD.
No sales, reach, engagement, followers, event approval, sponsor approval, media approval, search ranking, advertising result, platform result, customer enquiry level, brand exposure level or commercial outcome is guaranteed.
Private or unlisted links are intended to reduce public visibility, but we cannot guarantee that a link, image, product page, artwork, post, video, campaign asset or listing will remain confidential if it is shared, forwarded, screenshotted, indexed, cached, downloaded, saved or otherwise distributed by others.
14. Limitation of Liability
To the extent permitted by law, we exclude liability for indirect, incidental, special, or consequential loss arising from your use of the website, purchase of products, custom merch services, sponsored vehicle services, Pride & Joy services, private crew services, social promotion, media add-ons, listing removal, listing pausing, campaign changes, profit split arrangements or use of any supplied material.
Nothing in these Terms excludes, restricts, or limits any rights or remedies you may have under the Australian Consumer Law or other applicable mandatory laws.
15. Privacy and Website Use
Your use of the website may also be subject to our Privacy Policy, Cookie Policy, and any other policies published on our website from time to time.
You are responsible for maintaining the confidentiality of your own account information, login credentials, and devices used to access the website.
Where you provide photos, videos, social handles, names, vehicle details, contact information, sponsor details or other information as part of a merch package, listing, promotion or campaign, we may use that information in accordance with these Terms, our Privacy Policy and the relevant package or written agreement.

We may update or replace these Terms of Service from time to time.
Any changes will take effect once published on this page, unless a later date is stated.
Your continued use of the website after updated Terms are published constitutes acceptance of those updated Terms.

These Terms are governed by the laws of Australia.
